Legal Information

In order for your marriage to be solemnised in Australia, we will need to prepare certain statutory legal documentation and submit these to the Registry of Births, Deaths and Marriages.  Both partners must be over the age of eighteen (18) years old and two (2) witnesses must be present.

The Notice of Intended Marriage (Form 13)

This form is required to be completed and submitted to me no later than one month and one day prior to the ceremony date and no earlier than eighteen (18) months prior to the ceremony date.  I am able to prepare the form on your behalf, however certain documentation is required from yourselves.  Refer to the section below for further information.  Only one signature is sufficient for witnessing and the form can be fnalised, in my presence, up to one hour prior to the ceremony, if necessary.

In closing, all necessary paperwork will be lodged on your behalf with the Registry of Births, Deaths and Marriages within the appropriate time frame.

I will ensure that this important process is as seamless and stress free as possible.   

 

 

What you need to do

The following documents will be required:-

  • Evidence of birth - a birth certificate or extract of both partners.  If you were born outside of Australia, a current international passport will suffice if you have misplaced your birth certificate.
  • Divorce or Death Certificate - If either partner has been previously married and since divorced or widowed, if applicable.
  • Change of Name Certificate - if either partner has completed a change of name.

Each document must be an original.  Photocopies or photocopies witnessed by a JP will not be accepted.  All documents must also be in English.  If any document is in a foreign language, a translated version will be required.  The accredited translation and the original document must be provided.  For further information on translation services or to locate your nearest translator, please contact the NAATI (National Accreditation Authoirty for Translators and Interpreters Ltd).

If you are unable to locate your original birth or death certificate, you should contact Births, Deaths and Marriages in the State where the event took place.  For example, if you were born in Western Australia, you will need to contact the authorities in that State.  If you are unable to locate your original divorce certificate, you can obtain another copy by contacting the Family Law Courts.
